Regulations

Effective Date: January 1, 2025

1. General Provisions

1. These Terms and Conditions (hereinafter referred to as the "Terms") set out the rules for using the online store operated at the following address: www.raypath-eco.com (hereinafter referred to as the "Store" or "Online Store").

2. The owner of the Store and the entity providing the electronic services is:

  • NavyBlue Web Tech Oskar Brózda (hereinafter also referred to as the "Seller" or "Service Provider"),
  • operating as a sole proprietorship,
  • registered office: ul. Tomickiego 19/28, 31-982 Kraków, Poland,

3. The entity providing online payment services is Autopay S.A and PayU S.A.

4. These Terms are addressed both to consumers and entrepreneurs (to the extent permitted by mandatory legal provisions).

5. The use of the Store is possible provided that the user's terminal device and IT system meet the following minimum technical requirements:

  • access to the Internet,
  • an up-to-date web browser (e.g., Google Chrome, Mozilla Firefox, Safari, Opera, or Microsoft Edge),
  • cookies enabled (optionally, depending on the user's preferences, subject to the Privacy Policy).

2. Definitions

1. Customer – any natural person, legal entity, or organizational unit without legal personality who makes purchases in the Store.

2. Consumer – a Customer who is a natural person making a legal act (purchase) not directly related to their business or professional activity.

3. Entrepreneur – a Customer making purchases for purposes related to their business or professional activity.

4. Goods/Product – a movable item (physical products) available in the Store that may be the subject of a Sales Agreement.

5. Sales Agreement – a distance contract concluded between the Customer and the Seller via the Store, on the terms specified in these Terms.

6. Business Days – days from Monday to Friday, excluding legally designated holidays.

7. Terms – this document outlining the rules for using the Store.

3. Account Registration and Use of the Store

1. Purchases in the Store can be made either:

  • without registration (as a “guest”),
  • after creating a user account (optional).

2. Creating an account is done by:

  • filling in the registration form available in the Store,
  • providing the required information (e.g., email address, password),
  • accepting these Terms.

3. The Customer may delete their account at any time by sending a request to: contact@raypath-eco.com. The Store reserves the right to block or delete a User's account if the User violates legal provisions or these Terms.

4. The Seller makes every effort to ensure that the Store operates continuously and without failures. However, full correct operation at all times is not guaranteed, e.g., due to necessary maintenance or unforeseen failures beyond the Seller's control.

4. Placing Orders and Concluding the Sales Agreement

1. The information about Products provided in the Store, such as descriptions, prices, and availability, constitutes an invitation to conclude a contract, and not an offer in the sense of the Civil Code.

2. To place an order, the Customer must:

  1. Add the selected Product to the shopping cart.
  2. Provide the necessary information (e.g., shipping details, contact information if not logged in).
  3. Select the payment method and delivery option.
  4. Confirm the order and make the payment (or choose cash on delivery, if available – in this case, it is not available).

3. The maximum time required to complete the order and prepare it for shipment is 2 business days, counted from the time the notification confirming the order's transfer for processing is sent. This period may be extended for reasons beyond the Seller's control, such as a lack of stock or other independent circumstances. The Seller will promptly inform the Customer if such a situation arises.

4. The Sales Agreement is concluded upon the Customer receiving an order confirmation from the Seller at the provided email address.

4. The Seller reserves the right to correct any errors in product descriptions, prices, or stock levels. In the event of significant discrepancies, the Seller will promptly inform the Customer, allowing them to cancel the contract or confirm the order under the corrected conditions.

5. Prices and Payment Methods

1. All Product prices are given in PLN (Polish zloty) and include VAT, unless otherwise provided by law. In the case of sales to other countries, additional currency conversion information may be provided.

2. The Customer may choose the following payment methods:

  • Autopay (online payment processing by Autopay S.A.),
  • PayU (including credit/debit cards, BLIK, and other forms available via PayU).

3. VAT invoices (in electronic form) are sent to the email address provided by the Customer during the order process. Consent to receive electronic invoices is voluntary but necessary for order fulfillment.

6. Delivery and Order Fulfillment

1. The Seller delivers orders through the following companies:

  • InPost,
  • DPD.

2. Deliveries are made within Poland and within the European Union. Exporting goods outside the EU is not possible.

3. Delivery costs depend on the chosen delivery method, order size, and destination. Exact costs will be displayed during the order process.

4. The delivery time within Poland is usually about 2 business days, and within other EU countries about 3 business days from the moment the payment is credited (or from order confirmation in the case of electronic payments).

5. In the case of credit/debit card payment, the order fulfillment time is calculated from the moment a positive payment authorization is received.

6. Personal collection of goods is not available.

7. In the event that the product is out of stock, the Seller reserves the right to delay order fulfillment. The Customer will be promptly notified via email and has the right to cancel the contract or agree to an extended delivery period.

7. Right of Withdrawal (Returns)

1. The Consumer has the right to withdraw from the distance Sales Agreement without providing any reason within 14 days from the day of receiving the goods. For contracts concluded outside the business premises, this period is 14 days from the day the contract is concluded.

2. To exercise the right of withdrawal, the Consumer should submit a clear statement to the Seller (e.g., sent by email to: contact@raypath-eco.com or by traditional mail).

3. The Consumer may (but is not required to) use the withdrawal form provided by the Seller or available on the Store's website.

4. In the event of withdrawal from the contract, the Consumer is obliged to return the goods to the following address:

promptly, but no later than 14 days from notifying the Seller of the withdrawal.

5. The Consumer bears the direct costs of returning the goods.

6. The Seller will refund the payments received from the Consumer for the Products, promptly and no later than 14 days from the day of receiving the Consumer's withdrawal statement, subject to the possibility of withholding the refund until the returned goods or proof of their return is received.

8. Complaints and Warranty

1. All complaints regarding products or the functioning of the Store should be directed to:

  • email: contact@raypath-eco.com (with the subject "Complaint"),
  • address: Raypath Eco – Complaints, Grottgera 76, 32-020 Wieliczka, Poland.

2. The Consumer may use the Product Complaint form available on the Store's website.

3. The Seller will review the complaint within 14 days from the date of receipt. If the complaint is incomplete, the Seller will request additional information from the Customer.

4. Products are covered by a warranty:

  • 18 months (for natural persons – consumers),
  • 6 months (for entrepreneurs).

5. Regardless of the warranty, the Consumer has the right to claim under the statutory warranty (as per the Civil Code).

9. Refunds

1. Parcel Inspection:

  • Before accepting the parcel, check the condition of the package. In case of damage, ask the courier for a damage report and send it to contact@raypath-eco.com within 4 days. Report complaints within 7 days of delivery.
  • When collecting from a parcel locker, inspect the package on-site and, in case of damages, take photos and report them to the provided email address.

2. In the case of a return of goods in accordance with these Terms, we refund:

  • The full purchase amount for the Products.

Refunds are processed within 14 days from the receipt of the returned product. The Seller will refund the payment using the same method used by the Consumer, unless the Consumer has explicitly agreed to an alternative refund method that does not incur any costs. The return shipping costs are borne by the Customer.

10. Seller's Liability

1. The Seller makes every effort to ensure that product descriptions and prices are current and free from errors. In the event of obvious mistakes, the Seller will promptly inform the Customer and allow them to cancel the order or proceed under amended conditions.

2. The Seller reserves the right to delay shipment in case of stock shortages or other unforeseen events, and will promptly inform the Customer.

3. To the extent permitted by applicable law, the Seller is not liable for interruptions in the operation of the Store caused by factors beyond its control (e.g., force majeure, server failures, hacking attacks), but will take necessary measures to restore full functionality as quickly as possible.

11. Final Provisions

1. In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, and the Act on Providing Services by Electronic Means.

2. Any disputes arising in connection with the use of the Store will be resolved by the court having jurisdiction over the Seller's registered office, although in the case of Consumers, the court competent under applicable law (e.g., the court for the Consumer's place of residence) shall have jurisdiction.

3. The Customer has the option to use out-of-court dispute resolution mechanisms, including:

  • assistance from the appropriate municipal or district consumer ombudsman,
  • through the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr/.

4. The Seller reserves the right to change these Terms for important legal, organizational, or technological reasons. All changes will be communicated to Customers in advance, e.g., via email. The revised Terms will be binding no less than 14 days from the publication of the new version, unless the Customer has previously opted out of the services.

12. Data Protection

1. The data controller is the Seller, whose details are provided in point 1 of these Terms. Customers' personal data is processed for the purpose of fulfilling the Sales Agreement, handling complaints, and, with the Customer's consent, for marketing purposes.

2. The legal basis for processing personal data is Article 6(1)(b) of the GDPR (necessity for the performance of the contract) and, where required, Article 6(1)(a) of the GDPR (Customer's consent).

3. The Customer has the right to access, rectify, delete, or restrict the processing of their data, as well as the right to data portability and to object to the processing of personal data.

13. Privacy Policy

1. Detailed information regarding the processing of personal data can be found in the Privacy Policy available on the Store's website under the Privacy Policy section.
